Should Arbitrators Be Appointed For Resolving Conflicts Between Tourism & Power Projects?

The case should be amicably resolved in the arbitration and conciliation. Also, there is a need for modifications. The forest clearance should be dealt appropriately.


Off late there have been many power projects which have been coming up as a sign of development in the society. But sadly, there are many rejections and objections, which has been taken up by the tourism minister in connection with the built up of the projects. The major concern that arises is the environmental safety and health. In the most recent case, the ministry of environment has acted very carelessly by ignoring the objections for the power projects raised by the ministry of tourism. It seems like Tourism and Power Projects cannot go hand in hand together.


There have been discussions and meetings with regards the power projects and the final conclusion at which the ministers seems to have arrived is the plan for modification in the power projects as per the needs and taking in view the objections which has been raised by the tourism minister. Local stake holders seem to have already filed a case against the project. There has also been a demand to place on record the objections of the tourism and culture minister for the hydro project. The project was granted clearance in the year 2010.

It looks like in year 2012 the project was also granted wildlife clearance. It was granted by overruling all seven independent members of the National Board for Wildlife who opposed the move citing potential downstream impact on the National Park in Assam. The forest clearance was also granted.


As usual the dispute knocked the door again last month reasoning that if the project is allowed then it shall generate debris of which is likely to harm the holy site of Parashuram Kund. The beauty and glory both will be lost.


At present the project is under stay and forest clearance to the project is under challenge. Should the case be resolved under Arbitration and ADR Proceedings? Yes the case should be dealt through arbitration and conciliation and along with this some modifications should be made in the project as the objections which have been raised by the tourism minister, which was ignored.
